If you were 21 or older at the time of the offense, each case on your record may be eligible for expungement if:

  1. The offense is no longer a crime. Examples of these offenses include:

    • possession of less than 2 ounces of marijuana

    • being in the presence of heroin

  2. Someone falsely used your identity or you were misidentified;

  3. There were “demonstrable” errors by law enforcement, witnesses, or court staff that led to the creation of the record;

  4. There was fraud or corruption in the court process
