If you were under age 21 at the time of the offense, each case on your record may be eligible for one of two types of expungement:

  1. The offense is no longer a crime. Examples of these offenses include:

    • possession of less than 2 ounces of marijuana

    • being in the presence of heroin

  2. You only have one or two cases on your record, ever (see tip below if you have more than two cases)

TIP: Because expungement is based on each case separately, you may be able to expunge your record by seeking to expunge the decriminalized offenses first, and then attempting expungement the other cases if only one or two court cases are left on your record.
